Most Cappas had it altered and still didn’t wear it.
It had no connection or relationship to the original design or to anything remotely Cappa.

The Cappuccino Club is now the Applicant of a trademark
I applied the TM on the basis that it needs to be protected from errant abuse, as has happened recently withthe “yellow peril” kit
It has never been a problem until now.
Recently led by Zukerman, a small group of Sartorially challenged individuals were offered to purchase a new kit
It was only offered to a “segregated” few, the chosen ones. Its the greatest act of “bastardry” in the history of the Cappuccino Club
It was offered through a covert Whats App, not on any of the 3 current Whats Apps
Being The Regular Cappas, Boulie Tuesday or Cappa Social Events.
Zukerman has now closed down The Regular Cappas as he could not take criticism.
Some purchased, without the knowledge it was a segregated offer
It was not offered to all on the Cappa list, as has been the policy since we started riding together 1987
The Kit is an abomination & an embarrassment to the Cappuccino brand
Those who wear the shite will be the laughing stock of the Beach Road & beyond
History
Since 1987, for the last 37 years whenever a new kit is suggested, generally every couple of years, a few Cappas get together & come up with a design.
It’s always openly discussed.
The last blue kit was designed by Zukerman, Leiba & Chisik. It was a popular kit & most Cappas purchased it.
I consider the owners of the Cappa brand (intellectual Property) are the ones that have put time & energy into the Cappa Club over the years & The Renaissance men, all 17 of them, & a few others, who financially to contributed to the new website.
Our 3 newest members contributed to it.
The Renaissance Men came to the fore when the old website could not be accessed & financially backed the Cappa Club new site

Zukerman, the organizer of the “yellow peril kit” is not a Renaissance Man, he did not contribute to the cause.
Therefore, going forward, the old policy on any new kit will be enforced.
It must be offered to all Cappas & not a segregated few.
If anyone decides to use the trademark without “group approval” they will be personally at risk.

Furthermore, I am told that there is some opposition to my registering of the Trademark.
The Cappa Club is an Unincorporated Association.
Therefore it cannot register “anything” in its own name as it’s not a legal entity,

The first Yahoo groups was set up by David Harper & he was the Administrator.
The original website was also set up by DH & he was the sole administrator.
Harry Lew was also an administrator, I think of the Google groups
David Klein, then somehow became the Secretary & also the Administrator of the website.
David Harper approached me about 8 years ago to take over the website & Facebook
Which I did, no one else was interested.
The last 8 years I have been funding the website to the tune of $200 pa, now some $1,600.
I could not be bothered to “rattle the tin” each year to get others to contribute.
When the old website could no longer be accessed to allow upgrades (password etc. lost)
The website however was old & out of date & needed a lot of work & could not be accessed by mobile phone.
New Website
I then put a proposition to the Boulie Group one morning to financially assist to establish a new website & the majority of the group contributed (except one)
Eventually 17 Cappas contributed to the new website.
I worked with Atomic Energy to set the website up, quite a laborious task.
I continually work on the website & post on Facebook generally every 2 or 3 days.
I recently applied for registration of a Cappuccino Club trademark in good faith, no ulterior motive.
Just as an extra precaution & thinking of the future where one day the Cappa Club may become an Incorporated Association
It was done at my cost.
I am quite experienced in Trademark matters as I regularly do so on behalf of my clients.
In my own toy business (over the last 2 years) I had to oppose someone attempting to register a similar trademark, to mine, it cost me some $20,000.
I cannot understand why my registering of a Cappuccino Trademark is such a concern, maybe its not, its only the “yellow perils” as most of the Cappa Clubs IP is already in my name, details follow

I consider the Cappa Club Intellectual Property that I hold in my name, to be the IP of the Cappuccino Club, not me. And I act as Custodian on behalf of the Renaissance Men, and a few others, the ones that saw fit to keep the history of the Cappa Club intact.
I can guess the names of the persons who want to oppose the Trademark registration.
There are about 4 or 5 people on the “yellow peril” list whom I could never acquiesce to under any circumstances.
And seen their leader would not even contribute to the Website, I look forward to seeing him fund this Opposition to the tune o $20,000 & it will take some 1.5 years to get to a Hearing & then another 3 to 6 months to get a decision. And if the decision is in my favour, they will be liable for my costs individually.
I suggest checking the IP Australia website
Therefore, the trademark is proceeding to registration & its up to the “yellow Peril” group to oppose it.
And at any stage that it starts to annoy or irritate me, I will walk away or just shut everything down.
